1. Scope and Contracting Party

These Terms & Conditions govern all purchases made in our online shop.
Seller/Contracting Party: Oskar Zaworski, “Dreamcollector Studios” (see Imprint for details). Consumers are natural persons acting outside their trade/profession; entrepreneurs are those acting in the course of business.

2. Products & Characteristics

Our items include hand-crafted resin pieces (e.g., figures, fossil replicas). Minor variations and tolerances are material/manufacturing-related and customary. Unless expressly stated, items are collectors’ pieces not suitable for children under 14.

3. Offer and Contract Formation

Product listings are not binding offers. By completing checkout you submit a binding order. We accept either by dispatch/shipping confirmation or separate order confirmation email (or by requesting payment in certain flows). Automated order receipt only confirms we received your order.

4. Prices, Small-Business VAT, and Shipping Costs

All prices are in EUR. Pursuant to Sec. 19 German VAT Act (Kleinunternehmerregelung), no VAT is charged or shown. Any shipping costs are displayed before purchase.

5. Payment Methods

Accepted methods are shown at checkout (e.g., PayPal, credit/debit card, Klarna/SOFORT, Apple Pay, Google Pay, etc.). Payment processing is handled by the respective provider under its terms. For invoice/installment methods offered by third parties, those providers may run credit checks.

6. Delivery Area & Time

We ship from Germany to countries shown at checkout. In-stock items ship after receipt of payment. For made-to-order items, production may take up to 2 weeks plus shipping; current times are shown on product pages. Delivery is to the address you provide; for PayPal, the PayPal delivery address may govern.

7. Retention of Title

Goods remain our property until paid in full.

8. Right of Withdrawal (Consumers)

Consumers have a statutory 14-day right of withdrawal; see “Right of Withdrawal” below for details and the model form. Custom-made/personalized items are excluded where applicable by law.

9. Transport Damage

If goods arrive with obvious damage, please report to the carrier immediately and contact us as soon as possible. Your legal rights remain unaffected.

10. Warranty (Gewährleistung) and Liability

Statutory warranty applies.
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence, we are liable only for breach of essential contractual obligations (cardinal duties); in that case, liability is limited to foreseeable, typical damages. Mandatory liability under product liability law remains unaffected.

11. User-Provided Content for Personalization

If you provide images/text for personalization, you warrant you hold necessary rights and that no third-party rights (e.g., copyright, trademarks, personality rights) are infringed. You grant us a non-exclusive license to use such content solely to fulfill your order. You indemnify us against third-party claims arising from your content (except where we are at fault).

12. Promotional and Gift Vouchers

• Promo vouchers: non-purchasable, valid only during the stated period, one per order, no cash payout, no interest; minimum order values and exclusions may apply.
• Gift vouchers: purchasable and redeemable in our shop; valid until the end of the third calendar year after purchase; no cash payout; remaining balances retained until expiry; transferable.

We adhere to the Trusted Shops Quality Criteria (where applicable).

14. Alternative Dispute Resolution / ODR

We are neither obliged nor willing to participate in dispute resolution before a consumer arbitration board (Sec. 36 VSBG).

15. Applicable Law

German law applies with exclusion of the UN Sales Convention (CISG). For consumers, mandatory protective provisions of the country of your habitual residence remain unaffected.
